Pentest Data Retention: Questions Before Sharing Access

Inventory the information the service will receive

Testing can expose credentials, application data, architecture, logs, source code, and sensitive findings. Our pre-engagement data worksheet lists each information type, why it is needed, where it is processed, who can access it, and how long it is retained. Keep the list specific to the proposed method. An unauthenticated external assessment and a white-box engagement with source access have different handling questions even when they share the same provider.

Separate access secrets from evidence

Use an agreed secure channel for passwords, tokens, and other secrets. Ask how access is restricted, audited, and revoked. Evidence should contain only the information needed to establish the finding and support remediation. Define how unexpected personal or customer data is handled. Avoid collecting an entire dataset when a synthetic record or narrowly redacted observation can establish the point. A confidentiality statement should be supported by a practical operating procedure.

Ask about processing and subprocessors

For agentic services, understand whether prompts, code, logs, or evidence reach model providers or other subprocessors. Ask which terms apply to retention and training use, where relevant. Do not assume every service uses the same configuration as a consumer AI product. Obtain the actual engagement terms and applicable data-processing information. If a required residency or contractual restriction cannot be met, identify that mismatch before providing access rather than relying on informal assurances.

Define retention and deletion precisely

Record retention periods for credentials, raw evidence, working notes, reports, backups, and customer workspaces. Ask how deletion is requested and what exceptions apply. A portal account being removed does not necessarily mean every backup or report copy is immediately erased. Clarify legal or operational retention duties and the evidence available to confirm the agreed process. Make access expiration and credential rotation part of closure, independently of report retention.

Review a concrete handoff scenario

Suppose a white-box assessment includes a private repository and traces containing synthetic account identifiers. The worksheet should identify source-access duration, approved users, processing destinations, evidence restrictions, and post-engagement revocation. If the buyer later shares the report with an auditor, that creates a separate handling decision. Keep the provider’s obligations and the buyer’s sharing responsibilities explicit. The objective is a traceable information lifecycle, not a promise that a generic security badge answers every confidentiality question.

Give procurement and engineering the same handling summary. An approved contract is easier to follow when the team granting repository access understands the permitted processing destinations, retention period, and procedure for removing that access at closure.

Reference and next step

CISA’s security-procurement guidance is useful context for asking vendors concrete questions. The data-lifecycle worksheet here is our suggested diligence aid and is not legal advice.

Review FailSafe SWARM for the proposed testing model. Businesses considering a focused first engagement can review the first-pentest offer or discuss scope and evidence requirements before purchasing.

Questions about this topic

Direct answers to common questions about this page.

No. Use a secure channel agreed after authorization and scope confirmation, and provide only the required access.

Not necessarily. Confirm the provider’s actual retention, backup, deletion, and legal-exception terms for each information type.
